MERELY NOMINAL
ORDER FOR PERMANENT MAINTENANCE THREE PENCE A MONTH Threepence a month was the nominal amount of maintenance fixed by Mr Justice Kennedy when he gave reserved judgment in the Supreme Court this morning in connection with a petition for permanent maintenance which had been made by respondent in recent proceedings in which the parties were granted a divorce following a separation agreement. The petitioner iu the divorce ■ proceedings was Leonard George Scoble and the , respondent Marion Allison Scoble.
At yesterday’s hearing Mr A, C. Stephens appeared for respondent in support of her petition for permanent maintenance and Mr G. M. Lloyd appeared for the petitioner. “ The circumstances of the petitioner and respondent are such that the respondent is- hot entitled to an order for the payment of any substantial amount,’’ said His Honour in giving judgment, “ Indeed, the respondent is at present in a better position than the petitioner. Mr Stephens, for the respondent, asked, however, for an order for payment of a merely nominal amount to preserve the respondent’s rights for the future, and Mr Lloyd, for petitioner, conceded that such an order should be made.” His Honour said he had reserved judgment to consider the authorities cited. He had referred to them. They justified, in the circumstances, a merely nominal order. There would, therefore, be an order that the petitioner pay to the respondent during the joint lives of the petitioner and respondent the monthly sum of threepence, the first payment to become due within one month from date. No order was made as to costs. .
