DAMAGES AGAINST MOTORIST
APPLICATION FOR NEW TRIAL [Per United Press Association.] HASTINGS, November 6. Damages amounting; to £1,330 were awarded Airs Mary Uichardson in the Supreme Court at Napier to-day in a case arising out of a fata] collision between n ear and a cycle. 'Hie defendant, Sydney Victor Baum field, in his evidence, said that the victim was cycling on the wrong side of the road, 'and the motorist attempted to overtake and pass inside the cycle. The cyclist swerved back to his correct side and was struck by the car and killed. The jury found that the driver of the car had the_ last opportunity of ■avoiding the accident, and found favour of the iplaintiff by a majority verdict. The defending counsel gave notice of his intention to apply for a retrial.
