MAGISTRATE’S COURT

THURSDAY, AUGUST 24. (Before Air H. J. Dixon, S.M.) JUDGAIENT BY DEFAULT. Judgment for the plaintiffs, with costs, was given in the following undefended cases:—Dunedin Wholesale Alilk Ltd. v. 'Alary Byall, £l2 Is, goods supplied; T. W. Dobbie v. Harold Ross, £4 15s, money advanced; W. Harris and Son Ltd., v. A. J. Chrystall (Temuka), £1 13s, goods supplied; Dawsons Ltd. v. S. L. Smith, £4 Is, goods supplied; Simpson and Warrington v. Gordon Hare (Alilburn), £9 6s, services rendered; Silver Fern Taxi Company Ltd. v. A. Guy, £2 2s 6d. taxi hire; John Edward Butler Ltd. v, Albert Coombs ((Rakaia), £5 16s Id, goods supplied; William Taylor and Sons Ltd. v. Arthur Edward Jones (Waitati), £2 Is 3d, supplied. JUDGMENT SUMAIONS.

J. Holloway (Invercargill) proceeded against S. Daniel claiming £6 10s Cel on a judgment summons. There was no appearance of the judgment debt or, and the Magistrate made an order for payment of the amount, with costs, in default seven days’ imprisonment.

DECISION RESERVED. The hearing was concluded of the case in which Cecil (Robert Ooutts (Mr G. B. P. Wilson) claimed from the Tilbury Forwarding Company Ltd. (Mr N. N. Haggitt) £64 13s 2d as damages arising out of a collision between two motor trucks which occurred at Palmerston last November. Evidence on behalf of the parties was heard on Tuesday, and this morning legal argument was heard, after which His Worship said he would reserve his decision. (Before Mr H. W. Bundle, S.M.) POSSESSION CLAIMS. Evelyn E. M'Nish (Mr G. T. Baylcc) proceeded against C. B. Boatwood (Mr O. G. Cooke) claiming (possession of a dwelling in Stuart street. Portion of the evidence had been heard at a previous sitting, and after hearing another witness and legal argument by counsel, the Magistrate granted the order forthwith, the warrant not to bo issued for 14 days. Claiming possession of a tenement in Stafford street and arrears of rent amounting to £29 18s 9d, John Butler (Mr K. Stewart) proceeded against William Henry Ede (Mr A. J. llaub).

After hearing the evidence of both parties, the Alagistrate said he was unable to make any order in the meantime, and tho case was adjourned sino die.
