THURSDAY, DECEMBER 1. (Before Mr J. R. Bartholomew, S.M.) UNDEFENDED CASES. Judgment for plaintiffs, with costs, was given in the following undefended cases:— The Commissioner of Taxes v. Ronald Charles Blackmore, £4 9s Bd, income tax due; the Commissioner of Taxes v. Percy Herman Urquhart, £5 6s 2d, income tax due; Ernest Jensen Stewart (Burnside v. Herbert Anderson (Bumside), £6 3s 3d, goods supplied; the Sun Insurance Office Ltd. v. E. H. Crawford. £lO 17s lid, premiums due; Turnbull and Jones Ltd. v. Alexander Miller (Brighton), £4 5s 9d, goods supplied; the Para Rubber Company Ltd. v. A. Butler (Balclutha), £l6 Is 3d, goods supplied. CLAIM FOR DAMAGES. Damages amounting to £llO Os 2d were claimed by James Smith (Hillend) from Harold Banks, as the result of a collision between motor cars driven by the plaintiff and defendant respectively, at Winchester, on July 17, 1937. The amount claimed comprised £7O Os 2d, the cost of effecting repairs, £25 depreciation, and £ls for loss of use of the car for three weeks. Mr E. J. Anderson appeared for the plaintiff, and Mr J. B. Deaker represented the defendant. The cause of the collision, as set out in the statement of claim, was the negligent and unskilful manner in which the defendant’s car was driven. The defendant counter-claimed for £lO9 l()s 4d. £69 10s 4d being the cost of repairs, and £4O depreciation, alleging that the plaintiff had driven his car in a negligent and unskilful manner.

The case was proceeding this afternoon.
