(Before Mr H. W. Bundle, S.M.) TWO CHARGES. Michael Murphy was charged with drunkenness, and with assaulting Constable Ogilvie in the execution of his duty. Senior-sergeant Mae Lean said that yesterday afternoon at 5.12 a complaint was made to Constable Ogilvie in connection with the defendant going into shops. He was a flower seller, and the constable had occasion to speak to him. The man was undoubtedly very much affected by liquor. There was a struggle, and both defendant and the constable had a rough handling. It was not one of those vicious assaults on the police; it took place during defendant’s arrest. On the charge of drunkenness the defendant was fined 20s, in default twenty-four hours’ imprisonment. The Magistrate said that ho could not look upon ,it as an ordinary case of assault. The man was drunk, and, as he had taken out a prohibition order. His Worship suggested that the assault charge should bo withdrawn. The charge was accordingly withdrawn. THEFT CHARGE. A man whose name was suppressed until the facts have been gone into was charged with the theft of a suit case and its contents, valued at £7 15s. Mr Hamer, who appeared for the accused, asked for a week’s remand, as there were certain aspects of the case that he wished to go into. Chief-detective Young said he had no objection to the remand. The accused had been frank, and was suffering from war injuries. The accused was remanded till September 8, bail being allowed in his own recognisance to the amount of £25. CASE ADJOURNED. An adjournment for a week was granted in the case of Eric George Velenski, charged with selling liquor without a license and with manufacturing wine for sale without a license. Mr C. J. L. White appeared for the defendant. CHIMNEY FIRE. A chimney fire cost Colin Archibald Wardrop 5s and costs. MOTORING OFFENDERS. Charged with being in charge of a car without the prescribed lights, Frederick Hayes Elsom was lined 5s and costs. Samuel Brougham Jacobs, who was represented by Mr I. Stevenson, pleaded guilty to a charge of dangerous driving, and was fined £5 and costs. Charged with being unlicensed drivers, Aubrey Newlands Wytock and Charles A. C. Petherick were fined 5s and costs. Stuart Duncan Parker was fined 20s and costs on a charge of dangerous driving. , Justin Moloney, who was charged with driving a motor car over the intersection in Stuart street when the red light was showing against him, was fined 20s and costs. Angus Washington Pike and William R. E. Stephenson, for whom Mr Green appeared, pleaded guilty to charges of dangerous driving, and were each fined 20s and costs. The following were fined 5s and_ costs for having vehicles insufficiently lighted:—John Montgomery Somerville, Alfred Morrison Weaver, Percy J. Harris, Edward L. Hope, Gilbert Kitto, Andrew F. Morrison, and Thomas D. White. On a similar offence Albert _ Robert Irving, who appeared voluntarily, was fined 5s and costs 3s. “ The practice is a very dangerous one to the man himself and to everyone else using the road,” said His Worship in fining Peter B. Wildey 10s and costs on a charge of dangerous driving, the offence being that the defendant crossed an intersection on his motor cycle without having his hands on the handlebars. Charged with having a car without the assigned number, Henry Emmett Shiel was fined £3 and costs. CONVICTED AND DISCHARGED. Lionel Roland Robert Horn appeared for sentence on a charge of stealing 18s 6d. Chief-detective Young said that the accused, on two indictable charges, was sentenced in the Supreme Court yesterday to two years in the Borstal Institute.
On the present charge he was convicted and discharged.
