In evidence it was stilted that Kelly. .Morrison, and Pine wore a syndicate ol racing men who assisted .Jarden to purchase stables at Lower Hint and installed him as tra i ner. " And (lain t yon!'” Whereupon Jarden replied in the negative and bit him on the jaw. Kelly and Morrison supported Pine's evidence. .1 a rde n staled that be questioned Pirie about bis statements, and the latter adopted a threatening manner, and. thinking be was going to fie bit. be struck first. Another witness said be thought. Piric was going io strike Jarden. The charge was dismissed conditional on delendant paying <<>urt costs and witnesses' lees.
