MAGISTRATE'S COURT
Tuesday, September 13. (Before Mr H. Y. Widdowson, S.M.) CLAIM AND COUNTER-CLAIM. John Hanna sued John Purcell for £5 2s for rent of house at 93 Carroll street from March 7 (ill May 30. Defendant counter-claimed from Hanna tho sum of £ll 10s for work done in erecting a fowlhouse and effecting other repairs.—Mr E. G. Anderson, who appeared for plaintiff, said defendant ended his tenancy on May 30, having to be got out owing to his not paying his rent and his unclean habits about' the place,—Evidence was given by plaintiff and his son.—Purcell stated that ho left the house on May 20 and gave up tho key tho same night. His rent hook was kept at Hanna’s place for weeks at a time. —William Mason, carrier, said he shifted Purcell on May 20. The furniture was stored, but he did not know where tho Purcells went.—Mr Anderson: Don’t you know they aro now living the simple life on top of Lawyer Head? — Mason : No.—Mrs Purcell also swore that they left tho house on May 20, Sho was sure that was the date, because that day they bought a tent to live in.—Defendant being unable to pay tho 15s hearing fee for his counter-claim, it was struck out.— Mr Anderson said tho whole thing was a farce. Tho fnwlhouso was a collection of old timber and boxes not worth more than 30s at tho outside.—Judgment was given for plaintiff for £4 8s 6d, with costs (£1 16s). Costs amountin'? to 18s were also allowed against Purcell ou tho counterclaim. BY DEFAULT. Judgment by default was given for plaintiffs in the following cases:—D.l.C., Ltd. v. F. Bunting (Auckland), for costs (10s); Briscoe and Co., Ltd. v. Samuel Alfred Holley, £l7 18s 4d, for goods supplied, with costs (£2 15sf.
