MAGISTRATE'S COURT. (Before H. Y. Widdowaoii, Esq., S.M.} Judgment was given fox the plaintiffs by default, with costs, in the following cases:—Scoullar and Cbisholm v. James W. Cannan (Chatto Creek), claim £3 5s 9d, for goods supplied ; G. T. K. M'Kenzie v. John Hides (Waimate), claim £1 14s 7d, for goods.supplied; W. A. Scott and Sons v. Thomas Soden (Bannockburn), claim 14s 6d, on an account stated; T. E. Shiel and Co. v. Robert D. Benjamin (Christchurch), claim £l2 12s, for goods supplied ; Wright, Stephenson, and Co. v. William Borthwick (Milton), claim £4 lis, for goods supplied. ' *■ William Henry Parkinson v. Elizabeth, Smith and Mary Smith.—This was a claim for £ll 6s, being the fee for preparing plans for a dwelling and* outbuildings. The amount of the claim was 2i per cent, on the cost of the erection of the buildings (£550). Mr Ewing appeared for the plaintiff, Mr Calvert for Elizabeth Smith, and Mr A. S. Adams for the other defendant. After the plaintiff's case had been concluded, Mr Ewing 6aid he would rely on Mary Smith as the principal in the iase. —His Worship : Then- Elizabeth Smith, the other defendant's mother, goes out.—Mr Calvert eaid that he would ask for -judgment in his client's favor.—Mr Adams submitted that there was no evidence that Mies Smith was the principal in the matter. The evidence for the plaintiff, as a matter of fact, that Mary Smith was acting for her mother.—Judgment was given for the two defendants, with costs.
