COURT OF APPEAL.
[Pee United Peess Association,]
r WELLINGTON', December 21. Tho Appeal Court to-day gave judgment in re Dickens, which was heard on October 17. Regarding the question of the right of priority of the Public Trustee in tho administration of the estates of deceased persons, the Court decided that administration be granted to the widow, and that the Public Trustee pay the costs of the bearing. Mr Justice Chapman was tho dissenting Judge, contending that where the Public Trustee applied his application must prevail.
In tho Commissioner of Stamps v. Finch, the Court dismissed tho appeal, with costs on the lowest scale as from a distance, holding that the value of tho gift was under £I,OOO, and. further, that there was no benefit or advantage reserved to the donor, and that the gift was not therefore liable to gift duty under the Death Duties Acts of 1909 and 1911.
