COMMERCIAL TRUSTS ACT.
[Pie United Press Association.] WELLING-lu-n, August 23. Application was made before Mr Justice Sim to-day for stay of execution of a writ of discove'ry in the case of the Crown v. the Merchants' Association, under the Commercial Trusts Act. The association claimed the right to seal up parts of the minute book dealing with matter other than sugar, but the Chief Justice had ruled that the whole must be produced. In favor of the present application for stay of execution it was emphasised that the Court had always maintained the sacredness of private"rights. Defendants had the right of appeal, therefore the right to stay of execution. The possibility of an order for discovery leading to further prosecutions (counsel did not, say that it would) was a grave reason why the association should have the right of appeal. The Solicitor-General said there might be a stay of proceedings, but it would paralyse the force of justice. Argument is proceeding.
