WELLINGTON, October 8. The Appeal Court to-day are hearing tho Minister of Customs v. M‘Pariand. Respondent is a publican, who claimed the right, upon purchasing beer in casks from a brower, to drawoff and sell 2gal and upwards without affixing the duty stamp. His claim was upheld by Mr Justice Chapman, and the Minister appealed. Tho case turns on a clause iri the Act prescribing that “ no person ” shall sell except as provided. Mr Myers appears for appellant, and Messrs Skerrett and Sharp for respondent. Mr My rn contended that the word “ person ” referred to every person, and was absolute prohibition. If it meant to refer to brewers only, tho provision would be superfluous, as they were specially mentioned .in anotner i ection. The Act was not merely a revenue Act, bat was intended to regulate and restrict the sale of beer. %
