An important decision was given to dav by Mr Justice Cooper in the case Corporation of Dannevirke v. the Mayor of Dannevirke, an action for a mandamus to compel the mayor to put certain motiorr; to the Council which he had refused to do. His Honor held that the action of the mayor in relation to two motions' was ultra vires. He made an order for q mandamus, and allowed fourteen days for notice of appeal. If notice of appeal is given proceedings will be stayed pending the Court of Appeal's decision.
