THE CASE OF MINNIE DEAN.

An Application by her counsel to THE ATTORNEY-GENERAL.

Mr A. 0. HaiiloDj counsel for the defence of Minnie Dean on hbr trial for the murder of Dorothy Edith Carter,’ intends to apply at once to the Attorney-General for authority to move the Court of Appeal for leave to appeal. If the Attorney-General grants that authority, and the Court of Appeal gives the leave asked for, then a'case will be stated and the question of law which is involved will be argued before the Appeal Court. The question of law is as to whether the evidence regarding the murder of Eva Hornsby, and the finding 'of that child’s body and the skeleton of another child in Mrs Dean’s garden, was properly admitted against Mrs Dean when upon her trial for the murder of Dorothy Edith Carter.

It will be remembered that at the trial objection was taken by Mr Hanlon to the admission of the evidence referred to. When that question was raised Mr Justice Williams said that, though he considered there was no solid foundation for the objection, still, in fairness to the accused, he thought he ought to note the objection, so that the AttorneyGeneral might be moved for leave to have the point argued. Imthese circumstances, Mr Hanlon’s proposed application was of course to bo expected. The position being one of such grave moment, it is quite proper that the question at issue, as to whether the objects , is , , or ’: s uofc to be argued, should be decided by the authorities. We understand thin if the capital sentence is carried out the execution will take place at Invercargill;
