Booth v. tho Borough Council of Maori Hill. —ln this previously-heard case, in which judgment had been given for plaintiff on a claim for damages for injuries caused to his horse through defendants failing to keep a road in proper order, Mr F. R. Chapman now asked for a rehearing. Counsel said that since tho case was heard the Council had had the road out open, and found that instead of there being a culvert under it there was really only a hollow, or cavo under the road, and that was tho cause of the depression. As there was practically no culvert, it became a point whether there was anything in the nature of a duty devolving on. tho Council to know of the existence of the hollow and remedy it. —After Mr Fraser had argued in opposition to the granting of tho application, His Worship granted a rehearing on condition that the defendants pay the costs (L 5 13s) of the original case.
