W. breeze anchored inside the Heads Thoms Triumph has been ‘aid on to run between Dunedin and Sydney via E»st Coast ports. She will leave Port Chalmers (or her first Dip on this scivice about Tuesday next. IMPORTANT TO SEAMEN.
In the case of Rn««rs v. Brain and Kissling, (he Resident Magistrate (iur H. Cl. Seth Smith) at Auckland gave a decision which distinctly affirms the principle that the mister and seamen of a: ; vessel hare lien (or their wages upon the vessel in .hieh ifcey are engaged, and wheel;, r or net the owner or charterc r bicomc insolvent, they can go into the Admirals' Court and enforce that lien, thus making the v.ssel Pfdf liable for their w ages. The ca«c in question was brought by Mr Rogers, c aster of the cutter Dream, as against .Hr Hraiii, as owner of the ve-sel, and Mr F. Ki-sling, as charterer, for the recovery of L2B wages, and L(i (is addition-double wages (or delay in payment, ts pro dded for by sectioi 71 of the Shipping and Scarce 8 A-t 1877. His Worship deeded to tr &ke an order scan t Mr F. Kiss ling, as the charte er. He held however, that he could not make an order (or the sale of the vessel, as the section of the Act bearing upon that point only enabled such an order to be i> ade against the owner, and he could not hold that under that section the owner included the charterer. He further held that had this case le n irsti luted in the Admiralty Court tiie master would hare had lien on the vessel, and that the Admiralty Court could, therefore, have ordered her to he sold in order to satisfy such lien. Judgment was therefore given for the plaintiff far the amount claimed as against the charterer.— Scar.
THE LOCHNAGAR,
Invercargill, Hay SO. Respecting the telegram .ent throughout the Colony from Gisborne stating that anxiety ia felt for the safety of the ship Lochnagar, the chairman of the Southlind Underwriters’ Association has a memo, from the Merchant Shipping and Underwriters’ Association stating that the ship arrived at London safely on the 2nd inst.
It is somewhat strange that, according toa Gisborne tele/rana published by us yesterday evening, anxiety should be felt there for the safety of the-barque Lochnagar, as by the ‘Australasian Shipping News’ of the 9th inst we find that the Lochnagar arrived at London on the 2nd inst. She left Lyttelton on November 18, and called at Gisborne for wool and other cargo for London. -
