RESIDENT MAGISTRATE'S COURT.

Mosday, February 19.

(Before J. Bathgate, Esq., R.M.)

Judgment was given for plaintiffs by default m the following cases :—Walker v. G W. Cole, M.D., L2 18s 9d, for goods supplied ; D. Sampson v. Joseph Hinds, L 6 8a 6d, for clothes supplied; Same v. Charles Gregg, L 9 14s 6d. Wilson v. Islett.—Claim L2 4s, for goods supplied. Defendant admitted the claim and judgment was given for plaintiff for the amount claimed, with costs. Telfer v. Davidßon.—Claim, L 3 9s, for clothes supplied to defendant. In this case Mr Manaford, R.M., on Wednesday gave judgment for plaintiff for the amount, which was to be reduced to 5s if defendant returned the goods. Mr Mouat now stated that defendant had tried to return the clothes, but could not find plaintiff. Counsel therefore asked that his Worship would allow defendant to leave them at the Court, and issue an order for plaintiff to fetch them. Plaintiff had taken out an execution against defendant, and, through ill-feeling, wished to carry it out in preference to receiving back the clothes.—His Worship said he could not interfere in the matt r, but he would advise defendant to pay the 5s into Court and then formally tender the clothes to plaintiff; if the latter then enforced the execution he would do so at his Eeril. .• There appeared to be ill-feeling on oth sides, but the law was not to be used as a means of gratifying malioe.
