ONEKAKA CASE

HEARING OF APPEAL

The, hearing of an appeal by the Crown against a decision of the Warden's Court at Coilingwood in favour of the companies concerned in the Crown's suit for the forfeiture of mining privileges at Onekaka was commenced in the Supreme Court yesterday before the Chief Justice (Sir Michael Myers). The Warden (Mr. T. E. Maunseli, S.M.) had determined that the mining privileges were liable to forfeiture on March 14. 1938, the day immediately before the commencement of the Iron and Steel Act, 1937, but would not. in fact, have been forfeited if appropriate proceedings for their forfeiture had been taken. In his opinion, the Crown had committed a [breach of the agreement made in 1931 iby the Government then in power. The appeal is from this judgment on law and fact, and the hearing is expected 1.0 occupy some days. The Solicitor-General (Mr. H. H. Cornish, K.C.), with him Mr. C. A. L.
