RIGHT OF APPEAL
MILITARY SERVICE
A request to the Government to amend regulation 28 of the National Service Emergency Regulations,. 1940, was contained in a notice of question given by Mr. W. P. Endean (National, Remuera) to the Prime Minister in the House of Representatives yesterday. "Under the regulation in question, the Crown representative, in his absolute discretion, may permit a rehearing of an appeal or may refuse it," stated Mr. Endean. "This conflicts with the recognised principles of British law and justice."
Mr. Endean asked that the regulaton be amended so as to give an appellant desirous of appealing from a decision of an Armed Forces Appeal Board the right" to apply to an independent, judicial tribunal for leave to appeal, and, in the event of leave being granted, to give the appellant the right to have the appeal heard and determined by the independent judicial tribunal on grounds that might' seem just.
