NO DAMAGES
CLAIM BY WATERSIDER
After a retirefnent lasting from 4.25 p.m. to 9.13 p.m. a jury of twelve in the Supreme Court yesterday returned a majority verdict of ten to two for the defendant in the case in which Henry John Smallridge, a waterside worker, claimed £500 general damages and £155 lis 4d special damages from the Union Steam Ship Company of New Zealand, Ltd. The plaintiff was struck by a cased piario when he was working in the Wahine on March 23 and suffered injuries to his left side, and he alleged that the accident had been caused through the negligence of the company's employees.
Mr. Justice Smith presided. Mr. R. Hardie Boys appeared for the plaintiff, and Mr. G. G. G. Watson for the defendant company.
The defence denied negligence. After the jury's verdict Mr. Watson moved for judgment, and Mr./ Boys moved that worker's compensation be assessed in favour of the plaintiff, The defendant agreed to waive costs in the action before the jury and to pay £20 compensation.
His Honour said it was -a very generous offer on the part of the company. Had it been left.to him he would have ruled that the plaintiff should have gone back to work months ago.
