"INSULTING & PARTIAL"

JUDGE'S COMMENTS

MENTION BY MR. DE VALERA

(Received April 21, 1 p.m.)

LONDON, April 20.

The Premier, Mr. de Valera, in the Dail said that the Government regarded Mr. Justice Humphreys's observations at recent trials of Irishmen in London as most insulting and grossly partial. Representations had been made to Britain.

A cablegram from London on April 18 stated: —Eire has protested to Britain in connection with the sentencing on April 3 of Gerald Francis Wharton, a participant in the Irish Republican Army terrorist plot, when Mr. Justice Humphreys remarked: "You were a member of that gang which committed the murders of British officers up to 1922."

According to a cablegram published on April 4, the Judge also .said that Wharton was the worst and most dangerous of the accused. He fought against two Irish Governments and tried in vain to tunnel his way from prison. He was released in 1924 and received a pension from the Irish Government.
