UNUSUAL DEFENCE

INTOXICATION CASE

(Special to the "Evening Post.")

PALMERSTON N., This Day,

Varied excuses are offered at times by drivers before the Court on charges of being intoxicated while at the .wheel, but that tendered by counsel during the hearing of a case at Pahiatua yesterday must be classed as beyond the usual.

The defendant was William Udy, of Hukanui, for whom Mf. S. K. Siddells appeared. Counsel stated that while Udy would admit having had six beers during the afternoon, his condition of weakness had been brought about by an attempt to perform the feat of lifting one-handed a 12-stone man from a chair on to the bar counter. The strain of such extreme exertion caused Udy to be violently ill, and in order to recover he went and sat in his car, where he had been for about half an hour before being arrested by the police, who had been informed by telephone that there was a drunken man in a car. Udy had already arranged for his son to drive him home. He had not driven' nor had he intended to drive.

The Magistrate, Mr. H. P. Lawry, agreed that the offence was not' as bad as some, but the Bench had a duty to perform to the public. In view of the unusual circumstances, the least penalty he could inflict was to fine Udy £10 and cancel his licence for twelve month*
