CARPENTER'S CLAIM
JUDGMENT FOR DEFENDANT
A claim for damages totalling £1774 made by a carpenter before the Chief Justice (Sir Michael Myers) and a jury at Napier was concluded in the Supreme Court at Wellington this morning when the Chief Justice entered judgment for the defendant on the application of Mr. E. D. Blundell.
The claim was made by Sydney Edward Moore, a carpenter, for injuries sustained while working on a vessel owned by the defendant, the Shaw, Savill, and Albion Company, Ltd. Moore claimed £1500 as general damages and £274 10s 3d special damages, and after the case had.been heard at Napier the jury was asked to answer a number of questions and to assess damages as they should be paid if the defendant company was liable.
When the answers were given to the Court, Mr. Blundell moved for judgment for the defendant, and Mr. W. Nash, who for Moore, moved for judgment for the plaintiff and the case was adjourned to Wellington for a decision. When it was called this morning Mr. R. Watterson appeared on behalf of Mr. Nash and said that his application could not be supported in view of the answers given to three of the questions put to the jury, but this was not to be regarded as a consent to judgment.
Mr. Blundell then moved for judgment for' the defendant and it was entered with costs* and witnesses' expenses. -
