TECHNICAL ADJUSTMENTS

After the Attorney-General (the Hon. H. G. R. Mason) had moved the second reading of the Mortgagors and.Lessees Rehabilitation. Amendment, Eill in the HdVise of Representatives last night four clauses were added to clear up doubtful points in the law. The additional" clauses'were described by the "Minister ,!as technical adjustments, ...found necessary, for various reasons;-:? V-' . ' ' The Attorney-General moved the second reading of the Bill and explained the effect of its -provisions.After the Minister had spoken, four amendments were introduced by Governor-General's' Message and Mr. Mason explained them. The first amendment, he said, dealt with the reduction of debts. In. the Act debts were reduced on a date to be specified in the order made. Some orders did not specify the date and the amendment set out how the date was deemed to be fixed. Another amendment .provided that only specified adjustable debts were to be deemed to be discharged. ■ If a man .had express knowledge of an existing debt so that the creditor had no .chance of knowing anything about it, it could not be deemed to be discharged. The last judgment, or at least (I recent judgmr^it of the Court of Review, said the Minister, had mad« clearer the positipn regarding ' liability for rates, and it was apparent that some decisions previously given were not really in accordance with the intention of the Act. As the time for appeal against such decisions had run out another amendment really amounted to the provision of the right of appeal against some of the orders made. ■ The fourth amendment was a clause making reservations concerning the; question of reopening the problem of the guarantor if he was prejudiced under the clause in the Bill referring to guarantors. The amendments ■: were read a first time and referred-to the Committee on the Bill. -: • ■ .
