FARMING DISPUTE

A SOUTHLAND ESTATE

An appeal against the awarding by the Supreme Court of £336 19s 9d for work done and material supplied on a Southland estate, and the awarding of only part of three sums claimed as a set-off,. was brought to the Court of Appeal today. The Court consisted of the Chief Justice (Sir Michael Myers), Mr. Justice Ostler, Mr. Justice Smith, and Mr. Justice Johnston.

In the Supreme Court in August, 1936, Albert Edward Butson, a farmer, claimed from Mrs. Lily Elizabeth Padgett and Samuel William Butson, threshing mill owner, executors of the will of his father, Samuel Butson, who died on March 3, 1935, £331 10s for board and lodging, washing attendance, and other necessaries, £481 12s Id for work done and material supplied, and £15 for service fees.

The appeal today was against those parts of the judgment of Mr. Justice Kennedy, which awarded the plaintiff £336 19s' 9d for work done and material supplied, and allowed £30 only on claims for £479 3s 4d, £200, and £46 11s 8d made by the defendants as.a set-off. The motion on appeal asked that the decision as to the £336 19s 9d be reversed, and that the amounts claimed as a ..set-off be allowed.

The appellants, Mrs. Padget and Samuel William Butson, were represented by Mr. M. H. Mitchel, and the respondent by Mr. G. J. Reed. All the parties were of Parawa, Southland.
