WHARF ACCIDENT

CLAIM FOR DAMAGES

General and special damages totalling £586 19s were claimed in the Supreme Court today, before Mr. Justice Johnston and a jury, by Thomas Harris, wharf labourer, from the Union Steam Ship Company, Limited. Harris fell through a hole in the bilge of the Narbada when the vessel was being unloaded at Wellington on May 19, 1935, and.he alleged that the company had been negligent in allowing the bilge-decking to become insecure and broken; in covering the hole with mats; in failing to repair the hole before allowing work to proceed; and in failing to give any warning of the condition of Ihe bilge-decking.

Mr. O. C. Mazengarb ■ appeared for the plaintiff, and Mr. C. G. White, with him Mr. D. W. Virtue, for the defendant company.

The plaintiff alleged serious injury to his right knee which would permanently partially disable him. The company had paid, him £3 8s 5d a week compensation. The defendant company, in its statement of defence, denied any negligence. Compensation, it said, had been paid up to January 16. when the plaintiff had recovered sufficiently for light work. It was contended that he would be able to resume* his ordinary employment at the end of March. (Proceeding.)
