DOGS TO BE DESTROYED
Decision in the Alsatian dog sheepworrying case was given in the Magistrate's Court today by Mr. J. H. Luxford, SM. >
Mr. Luxfbrd said that after the evidence given yesterday, he was able to visit Paekakariki and make an inspection of the Alsatian "Max" sought to be destroyed and the other Alsatian belonging to Mr. Furlong.. It had been stated in evidence, and continued strongly by the defendant, C. John Kean, of Paekakariki, said the Magistrate, that the dog owned by Furlong was so similar in appearance to the other dbg that a mistake was liable to be made by.witnesses, and that the dog that did the worrying was not the dog "Max" belonging to the defendant Kean. The evidence for the plaintiff, Harold Smith, farmer, of Paekakariki, was that a mistake was quite impossible. . ~ ,„_ After having made an inspection Mr. Luxford said he was satisfied that it was impossible to confuse the dogs. Mr A. J. Mazengarb, who appeared for the defendant, said that he consented to an order that the dog "Max should be destroyed. _ An order was made that the dog be destroyed within seven days. As far as the civil claim was concerned, said Mr. Luxford, it was impossible accurately to estimate in general damages the effect of worrying sheep before lambing times. Some of the sheep had teen bitten and £5 general damages would be allowed, as well as the value of the two ewes killed, £2 10s. Witnesses' expenses and other costs allowed totalled £6 4s 6d. Mr. E. D. Blundell appeared for the plaintiff.
ANOTHER CASE "We can't have dogs killing sheep," said Mr. E. D. Mosley, SJVL, in the Magistral's Court today, when John Hugh Marshall, farmer, of Titahi Bay, asked that a dog belonging to Herbert Hastings, of Titahi Bay, should be destroyed because it had been worrying sheep. , . Mr. A. J. Mazengarb appeared for the plaintiff. • . _ Evidence was given by the plaintin that the dog had killed two sheep and had been chasing others. An order was made that the dog be destroyed within three days.
