A TAXATION POINT

A test case ot internist to radio manufacturers throughout! New Zealand came before Mr. Jus.Uce Smith in the supreme Court yesterday. The case involved a question ?*3 to the amount of stamp duty payablte on an agreement between Collier pnd Beale Ltd and the Australian Kp.dio Technical Services and Patents do., Ltd., whereby the latter granted tSie former certain rights in coniiectioei with radio ! pa tents.

Collier and Beale, LM., agreed to pay royalties to the Australian company. The amount payjtole as royalty was estimated, and the Commissioner of Stamp Duties assessed! the tax payi able on the agreement at 122s per £ 100 lof royalty. He did t.\is on the assumption that the agreement was "an instrument of purchase." It was argued yesterday on behalf of Messrs. Collier and Beale' that the agreement was not an instrument of purchase, and that it wsis a mere licence conveying no interest in property. It was contended that '.the stamp tax on the agreement shouSd be 15s only.
