CLAIM BY MORTGAGOR

SUPERINTENDENT SUED

A claim against tho Superintendent of the State Advances Office is being heard in the Supreme Court before his Honour the Chief Justice (Sir Michael Myers), arising out of the allocation of moneys advanced through the Treasury Department as financial assistance under mortgage in accordance with the Hawkc's Bay earthquake legislation and regulations.

An amount of £158 is claimed by Andrew Pixie, the mortgagor, and by W. P. Finch and H. A. Westerholm, architects, all of Napier. That amount is alleged to represent architect's fees which on Pixie's direction should have been paid by the superintendent to the architects, but which it is alleged was wrongly paid to the builders, in excess of the amount the builders were entitled to.

The action is an appeal from the decision of Mr. E. Page, S.M., given upon a claim in the Magistrate's Court. Facts as well as law are at issue.

Mr. J. Mason, of Napier, appears for the appellant, and Mr. C. H. Taylor, Crown Solicitor, and Mr. C. E. H. Ball appear for the State Advances Superintendent.
