Levvey, 5.M.,..in the case in which William Allan Alexander McEae and his son, William Robertson Mcßae, both of Dunsdale, farmers, were charged. with being concerned in unlawfully making spirits. An application by defending counsel the. charge , against Mcßae, jun., should be dismissed on the-ground that a prima facie case had not. been made out against him was rejected by the Magistrate:':, - .
