REICHSTAG FIRE CASE
TORGLER'S ALIBI
(Beceived October-6, 3 .p.m.) LEIPZIG, October 5. M. Torgler, in the Reichstag fire trial, gave evidence that he remained in a'-restaurant on February 27 (tho night of the fire), eating supper and talking with friends, including tho Communist Koeher, until 10 at night, when a waitor shouted, "The Reichstag is afire." Torgler said that, incredulous, he boarded a tram to go to the Btichsta,g. A Storm Trooper, yelling excitedly, "Of course, the, Communists, tho Communist 3 fired tho Reichstag!" prevented him from alighting near the Reichstag. Eventually he joined the crowd and assured himself that the Communist Party room was not afire, as tho window was visible.. He1 then rejoined Koener in the restaurant. Later he learned of an official communique - declaring that ho and Koener had been associated with Lubbe in firing the Reichstag. They were most indignant.
