MOTOR-CYCLIST FINED
INTOXICATED IN CHARGE
Stating that he. had a duty to the public, Mr. J; G. L. Hewitt, S.M., fined Eric Manning Foothead £7 10s. at the Magisthate's 'Court yesterday afternoon, ; for being found intoxicated in charge of a motor-cyeie.. '!■. ' ';' Sub-Inspector Martin said that at 1.30: a.m. on Sunday a constable found the accused, who was intoxicated, in the act of starting a motor-cycle in Rintoul street. The accused was-taken to the police station and twenty minutes later he was asleep in his cell. Counsel for the accused, Mr. G. C.Kent, said that Foothead was not addicted to drink, but had been to a party where he had consumed some "home brew." When j he went out into the fresh air the liquor affected him. , .. , s The accused, said counsel, had recently been in a relief camp, but had' saved up enough money to pay a deposit on a motorcycle delivery outfit. He had never been m trouble before, and was at present assisting to support two elderly aunts. In the circumstances counsel asked for a light penalty and that the accused's name should be suppressed. Mr.' Hewitt said that'he would take into account the accused's good character, but he pointed out that if the constable had not been on the scene the accused would have ridden the motor-cycle and no one, knew what might have happened. In this case the fine of £7 ; 10s to the accused would be as much to him as a fine of £15 or £20 to a person in a different position. The Magistrate ordered that the accused's licence should be endorsed He* refused to make an order for the suppression of his name.
