The Arbitration Court upheld the appeal of the JDobson minerj- Bruuner, who, with 133 others-was convicted on 18th j August by the Magistrate, Mr. MoV drum, on a charge of participating in an unlawful ■'■ strike at the Wallsend Mine., vThe miners said they objected {o. a tribute miner being engaged for surveying the mine. For tho appellant. Mr.. '.Ero-inan contended that the evjdenfee did not diseloso a striked arid iio; discontinuance .op work in pursuance of an, understanding to compel tho. employers .to agree- to conditions or accede to fleniands, or to cause loss. , Further, no agreement existed at the time.: If tho stoppage was a strike it -was not unlawful.'- T4io circumßtances of the case wero not con-, templated by-tho legislature. - His Honour Mr. 'Justice Frazer said, a strike was disclosed, but under section 4 of the Labour Disputes 'Investigation Act a strike "had to refer" to the conditions of employment.' It did not do so in this instance.. Section ; 9 required Hn agreement to be operating.. , ;, The. appeal was upheld as the strike was not unlawful. . . . ■ ' ■ . • .
