AL CAPONE'S APPEAL
CONFINED TO COUNTY GAOL
PENDING DECISION
(Received 29th October, 8 a.m.) CHICAGO, 27th October. The United States Circuit Court of Appeals granted Al Capono a writ supersedeas, delaying his removal to the penitentiary, but denied the gangster bail, forcing him to remain in the county gaol, without shortening his later penitentiary sentence, until he learns the result of his appeal on the latter sentence, which in to be presented to the United States Supreme Court.
The Government has requested the Supreme Court to reject the appeal from a three-year sentence on the part of Al Capone's brother Balph, who was convicted of failing to pay income tax.
