PILOT GETS DECISION

WANGANUI, This Day.
The Magistrate (Mr. Salmon)' delivered judgment -in the case of the police v. Captain Brake, charged with plying-for hire with an aeroplane at the Castlecliff Beach on Sunday, 21st June.
The Magistrate held that the aero, plane as we know it is commonly used for the conveyance of passengers, mails," and baggage. It is propelled by mechanical power. If the object of the statute by sub-section 3 of section 18 was to exempt from, .the operation of sub-section 1 all means of transport of passengers, .whether' for pleasure or necessity, then it would', -not be doing violence to the sub-section if he extended the meaning of th'c word "carriage" to include an aeroplane used for tho" carriage of passengers, mails, and lugfiiigc.
