MAN'S CONVICTION
DIRECTION TO JURY
Legal argument is being heard in the Court of .Appeal to-day on a motion made on behalf of William Alexander Johnston for leave to appeal against his conviction in the Supreme Court at Gisborne on sth June on a' charge of having indecently assaulted afgirl under 1(5 years of age. The application is based upon the grounds that Mr. Justice Blair refused to rescrvo under the Crimes Act, 1908, certain questions of law arising out of and incidental to the trial and arising -out of his Honour's direction to tho jury. It was claimed on behalf of tho prisoner that the Judge (1) wrongly directed the jury in certain respects; (2) that his Honour did not direct or sufficiently direct the jury as to the need for careful scrutiny of the uncorroborated evidence of the girl; (3) that his Honour wrongly admitted for the consideration of the jury the evidence of three children; and (.4) that the verdict of the jury was against the weight of the evidence.
