HOUSE DAMAGED
SUCCESSFUL CLAIM
Sheets of iron blown from the roof of the Kilbirnie Kinema during the gale 6u 2nd April caused some damage to a housa two doors away, and as a result the owner of the house, Hedley V. Evans, took proceedings at the Magistrate's Court yesterday against Williamson Films (N.Z.), Ltd., lessees, and Kilbirnie Theatres,, Ltd.. owners of the building. . The Magistrate (Mr. E. Page) gave judgment for- £15 to the owner o£ the house, who maintained that the defendants had been negligent with regard to the roof, and called some evidence of a previous ■occurrence. The defendants held that the unroofing had been an act of God. -.'■ Mr. Page decided that the damages wer« payable by the occupier' of the theatre, Williamson Films, Ltd. . Mr. E. M. Sladden appeared for Williamson Films (N.Z.), Ltd., Mr. R. E. Pope for Kilbirnie Theatres, Ltd., and Mr. R. H. Bannister for Mr. Evans.
