CLAIM ON AN ESTATE
Two of three daughters who made application in the Supreme Court at the beginning of this month for provision to be made for their proper maintenance and support out of the estate of their late father, Reuben King, who died at the age of 99, leaving real and personal estate worth over £6000, were awarded an allowance by Mr. Justice MacGregor, whose reserved judgment on the case was delivered yesterday. The applioants were Mrs. Emma Mockridge, of Petone; Mrs. M. B. Harrison, of Auckland; and Mrs. Walters, of Taita. With the exception of a legacy of £50 to Mrs. Mockridge, none of the daughters benefited under the will. On the evidence placed before him. his Honour decided that Mrs. Walters had not made out a case for relief, and her claim was dismissed. On the other hand his Honour held that Mrs. Mockridge was entitled to the further provision out of the estate of £1 weekly for life, and that Mrs Harrison also had establislied a claim for provision, which his Honour assessed at 12s 6d weekly for life. The residue of the estate under the circumstances is to be exonerated from the incidence of the order, and both of the periodic payments ordered are to be charged on the real estate of the testator. Costs were allowed to all parties out of the estate. Mr G. G. Watson appeared for the three daughters, Mr. T. C. A. Hislop for the trustees, and Mr. A. T. Young for the testator's son, Leonard King, and Mr. L. C. Hemery for the testator's grandson, Reuben King.
