COURT OF APPEAL
AN AUCKLAND CASE
Legal argument was concluded in the Court of Appeal to-day in tho case of Samuel Vaile and Sons, Ltd., real estate agents, of Auckland, against Stewart Douglas Harold James, carpenter, also of Auckland.
There wero on the Bench Mr. Justice llordmau, Mr. Justice Adams, and Mr. Justice Smith. Mr. A. Gray, K.C., with him Mr. P. B. Cooke, acted for tho appollant firm, and Mr. L. P. Leary for the respondent, James.
The case was an appeal from a decision of Mr. Justice Blair in the Auckland Supreme Court in holding that tho appellant, as the respondent's agent, had failed to carry out his instructions. A house at Ellorslie belonging to the respondent remained unoccupied for more than thirty days without" the insurance company which issued the policy being notified, and when the place was destroyed by fire tho company refused to pay out the full insum nee on the ground that its consent to tho house remaining unoccupied had not been obtained. Mr. Justice Blair gavo judgment for the respondent for £IKS.
