PARTNERSHIP CASE
AN APPEAL DISMISSED,
The Court of Appeal—his Honour the Chief Justice (Hon. C. P. Skerrett), Mr. Justice Sim, Mr. Justice Stringer, Mr. Justice Macgregor, and Mr. Justice Alpers—gave judgment in an appeal attest the judgment of Mr. Justice Ostler in a. case in which John Herbert Turner, liquidator o£ K. Alexander and Co., took action against Akelf in respect to a partnership dispute in connection with a sale of a business in Wellington. His Honour gave ■ judgment for plaintiff (Turner), and against this judgment defendant (Akel) appealed. His Honour Mr. Justice Sim read the judgment o£ the Court. Their Honours held that appellant's conduct in accepting the position of manager of the company's business, and in so acting for several months, was a complete recognition of the company as the owner o£ the business, and this amounted, in law, to a ratification of the agreement which had been made. In addition to this conduct, there were also the other acts referred to by Mr. Justice Ostler in his judgment which helped to establish ratification. The appeal, thorefore, was dismissed with costs on the lowest scale. Mr. A. AY. Blair appeared for appellant and Mr. H. F. O'Leary for respondent.
