UPPER HUTT COURT

' The monthly sitting of tho Upper Hutt Magistrate's' Court was held yesterday, before' Mr. "J. H. Salmon, B.M. William J. Paul, for being on licensed premises after hours, was fined £2. For failing to observe the weekly half-holiday, two storekeepers, C. T. Ellis and M. Williamson, wore each fined £1. ' Biding their bicycles at night without lights cost Hugh Watson, J. Sygrove, and W. Munn 10s each. Pour residents were charged with breaches of the Arms Act, H. F. Whiteman and F. J. Munn, for having firearms in their possession without permits, and L. H. W. Doughty and J. Wyeth, for delivering firearms to other persons without permits. Each was fined 10s. . J. Wyeth was also charged for failing to register a firearm, and was fined j £1. . Fighting in a public place cost Leo Kelly and J. Barder £1 each. Hugh M'Dowell, defended by Mr. A. J. Mazengarb, was charged with negligently driving, a motor-c; :• on 21st August, when he ran into a car standing on its correct side of the road on the Main road at Trentham. The defence was that he thought the car was about to turn, and that he went to get round it. When he found his mistake it was too late to avoid a collision. The mishap occurred on a wet night; The Bench considered it was a clear case of negligence. If defendant had ' thought the car was going to turn he should have slowed down and then I stopped. A fine of £2 was imposed. Carroll F. Lutz was charged with failing to keep his stockyard clean by allowing manure to accumulate. Inspector Wilson prosecuted and Mr. A. J. Mazengarb appeared for defendant. For the defence it was shown that tho. yard was a very large one, and that the part complained at was fenced off from the other portion, which was kept quite clean, and that the exceptionally bad woather had prevented the work being done. The Bonch said that the case was by no means a bad one, and would be met by a nominal penalty, A fine of £1 was inflicted. CIVIL CASES. Judgment for plaintiff by default was given in the following undefended civil cases:— J. A. Forrest v. W. Clark, 17s 6d; B. Bengo v. H. M'Nelly, £5 17s 6d. In judgment summons cases, F. Tay* lor was ordered -to pay J. H. Clare £11 4s forthwith, in default eleven days' imprisonment. H. M'Nelly to pay tho Ford Bales and Service, Ltd., £22 11 j lid, in default 22 days' imprisonment. In a defended case, W. M'Carthy (Mr. A. J. Mazengarb) v. H. Wheeler (Mr. H. Cornish), a claim was made for £3 6s 6d, the cost of repairing a watch, alleged to hqye been damaged by defendant's grandson, and for which it was alleged defondant had promised to payAs another boy was said to be concerned in the damage, judgment was givon for half the claim, £1 13s 3d.
