RIGHT OF APPEAL

Notice has been given by Messrs. P. Eraser (Wellington Central), and S. Atmore (Nelson) that they intend to move the following new clauses to th» Education Amendment Bill, giving teachers the right of appeal:-—-.,
(1) In addition to the appeals provided for in part XI. of the. principal Act, any teacher may appeal £o the teachers' court of appeal who,'having been an applicant for a position which an education board is required to advertise, has not been appointed to such position, and is at least as High on the graded list as the teacher appointed: Provided, however, that there shall be no right of appeal against, the appointment of a teacher whol has been preferred under subsection nine of gee* tion seventy-one of the principal Act. (2) The right of appeal conferred by subsection one of the section shall b« available against the appointment of any teacher of the class referred to in paragraph (a) of subsection: three of the' said section seventy-one, notwithstanding the provisions of subsection, two of section eight of the Education Amendment Act, 1921-22. (3) An ap« peal under this section against-non-ap» pointment to a position may" be made in the prescribed manner within "twentyone days nfter the teacher has received notice thai the position has been filled. (4) If upon au appeal under- this section the Teachers' Court of Appeal shall decide that the appellant ought to be appointed to the 1 position, ho shall bo entitled to be and shall be so appointed, and the appointment previously made by the board shall become, void. (5) The provisions of part XI. of-the principal Act shall apply to appeals under this suction, except where the same arc inconsistent with the provision's of this section. For the purposes of any such appeal .the district referred to in section one hundred and forty-eight n£ the principal Act shall be V.ia ..distil i in which the position in question' is situate." - - '■-
