After legal argument, Mr. Justice Herdman upheld the jury's award o? £350 damages for Hugh Gardiner, miner, father of a youth who was killed, against the Pukemiro Collieries, Ltd. Mr. Finlay had moved for a new trial or a nonsuit on the ground that the plaintiff had failed to establish negligence. Judgment was entered for £350, £150 for the.father and £200 for the mother of the deceased.
