The accuseds' companion, a boy named Dixon (14 years of age) gave evidence that he saw Heggarty shoot .the constable while witness held Willits' arm to stop him blowing his whistle. Crossley and Heggarty were escapees from a probationary institution. The constable was shot in the back while on his beat in Wolverhampton.
