ALLEGED RECEIVING

RE-TRIAL OF FITZGERALD,

COMMENCED.

. Certain dealings with motor-tires in 'February last were the subject ,of inquiry at the Supremo Court to-day, when. John Edward Fitzgerald, a wellknown Wellington motor-dealer, appeared in the dock on two charges of receiving stolen goods. Fitzgerald was first before the Supreme Court at the last criminal sessions but on that occasion the jury failed to agree/ and a new trial was ordered.

Mr. Justice Salmond presided at -the new trial, which opened to-day. Mr. P. S. K. Macassey appeared for the Crown, Mr. W. Perry represented the prisoner, and Mr. F. Cox was foreman of the jury. Some time was taken up in empanelling the jury, the Crown Prosecutor ordering seven jurymen to stand aside, and Mr. Perry challenging five. In opening Mr. Macassey remarked that .Fitzgerald was a well-known business man in Wellington, and had been engaged in the motor trade for many years. It was alleged -that hp received a number of tires from a young man named Spencer; who had been convicted of theft, and would give evidence. Mr. Macassey then went into the various transactions in detail, and read a statemeut made by the accused, who gave his version of the sales. (Proceeding.)
