TENANCY CASE

NOVEL LAW POINTS RAISED.

A tenancy case,. involving points of law which, it seems,, have not arisen before either in England or in this country, waS heard at the Supreme Court to-day. Mr; Justice Chapman occupied the Bench. Emily Blick, plaintiff, claimed damages against Catherine Nesbitt for alleged wrongful determination of a tenancy. The defendant sought possession of premises in Buller street in May, 1932, but failed to obtain am order of the^Coui-t. The premises were partially destroyed by fire, and plaintiff had to moye out with her family. The defendant" put builders in and repaired the premises, and, it was alleged, refused to allow plaintiff to resume her occupation. The law points involved were as to ■whether in an ordinary monthly tenancy, protected by the Housing Amendment Act, 1921, ;and the War Legislations Acts, a- fire amounted to a determination of the • tenancy, and whether the defendant had wrongfully' evicted the plaintiff.
