Every woman throughout New Zealand, as well as all members of the retail trade,' will be interested in the re- , cent cases -in. which Tootal Broadhurst Lee, Co., Ltd., of Manchester and London,, took' action to obtain injunctions against various retailers for improperly • passing off as the genuine article material inferior to Tobralco. Under the advice iof their solicitors, Tootal Broadhurst Lee Co., Ltd.,. at once instituted proceedings in equity against a number of these firms. Several cases were .withdrawn on receipt of an apology and explanation, but Tootal. Bradhurst Lee, Co., Ltd., iii the interests of their customers and the public, deemed it advisable to secure injunctions in certain instances, in order to, impress upon the trade the importance of the matter, and the serious view taken by them regarding the damage which was thus, done to their good name and reputation. In connection with the substitution cases it is only fair to the retail trade to point, out that in certain, instances evidence was.produced showing that the fabric had been purchased under the impression that it was the genuine guaranteed Tootal product. In other cases it was found that careless shop assistants misrepresented the goods without tha employer's authority or knowledge. Tootal Broadhurst Lee Co., Ltd., is an old and reputable British com • pany, which manufactures only the highest class cotton fabrics under its registered trade marks, which have been extensively advertised in New Zealand and. ■ throughout the world, viz., Tobralco, largely used for ladies' and children's wear, and also a popular shirting material; Tarantulle, fot lingerie and baby wear; Lissue Handkerchiefs for ladies; Pyramid and Lova Handkerchiefs for men; Tootal Cloth (a plain and corded velveteen); Tootal Pique, Tootal Shirtings, .and Namrit (a high quality voile, in. white and coloured designs). Each of tbfse productions is sold under an absolute guarauj tee of quality and service. The injunctions were obtained in order to bring before the public and the trade generally the fact that the Tootal registered trade marks are fully protected. Tootal Broadhurst Lee Co., Ltd., did not claim ; damages—they sought solely to protect the buyer and seller of their fabrics, and to establish due respect for their registered brands. Injunctions only were taken out this time as the firm did not wish to appear vindictive, but they will be reluctantly compelled to take more drastic, action to protect their goodwill in the event of further substitution. The great demand for Tarantulle, Tobralco, and other Tootal brands exists because the women of New Zealand have proved that Tootal fabrics are unequalled—and, know that they are fully guaranteed— and this confidence on the part of tha consumer must be protected. These injunctions show how necessary it is for every woman not only to ask for Tootal products—but to see she gets them.]: Every yard of Tootal fabric bears the registered brand. on each yard of selvedge. Every garment should bear the sewn-in label, Made of , Tobralco. Any reputable dealer will at once give ;hig customer the article asked for—thers may be a few who will endeavour to sell an inferior article carrying a larger profit, but the purchaser must insist on getting the guaranteed Tootol brand, ov;' on going elsewhere for it. — Adrt, ':
