TRAMCAR V. TAXI-CAB
CLAIM AGAINST CITY-COUNCIL/ '
A collision between a taxi-car and.' tramcar in Revans-strect on 25th October last was enquired into in tho Magis- ■' trap's Court, before Mr. W. G. Bid-, dell, S.M., when George Waddle, taxi- ; cab proprietor, claimed the.sum of £130! from the Wellington City Council. In i the statement of claim it was alleged!' that on the day in question defendant's ■',' servants, negligently controlled a tram- f car in Ravans-street, whereby the collision occurred, causing serious damage , to the taxi-cab. The facts" as atated by ' the plaintiff, for whom Mr. E. M. Beechey appeared, were that just alter he was leaving the Hospital grounds the engine of # his car stopped, and the car '.• wentjon'to the tramline. The tramcar, ■which was coming along, failed fey pull up, and crashed into the taxi-cab. For the defence Mr. J. O'Shea (City , Solicitor) submitted that the motorman " did everything possible under tho circumstances to prevent an accident. Ho ' did not know that Waddle's car waa , going to remain on the rails, and when he saw the danger he immediately ap-* plied the magnetic brake. After the cose r had been partly heard, the Magistrate 1' granted an adjournment:
