RESERVED JUDGMENTS

Reserved judgment was delivered by Mr. W. G. Bidden, S.M., to-day, in the civil action in which Arthur A. Carson claimed the sum of £25 lls from Easson, Ltd. The claim was made up as follows :— (1) To cash paid defendant on account of city rates, and (2) to half share of two years' rent of ten sections used as a horse paddock. The dispute as to the rates arose over a partnership account, and, after reviewing the circumstances in detail, his Worship said he was satisfied that the return of the money could not be demanded. As to the other matter, there was an uncertainty in plaintiff's claim, and the Magistrate was satisfied that he had not shown that he was entitled to the rent demanded. Plaintiff was accordingly non-suited, with costs (£1 Is). Mr. J. J. M'Grath appeared for plaintiff and Mr. T. Neave for defendant. Judgment was also delivered in the case of William Branigan v. Ethel Emily Howell, heard early in December. The claim was for £51 18s 6d, being £25 paid by plaintiff in settlement of a judgment against him in respect* of a guarantee from plaintiff to T. and W. Young apd others, together with £26 18s 6d costs incurred in connection v4th the same affair. The case arose over a matter concerning the lease of the Taita Hotel. Judgment was for plaintiff for the full amount claimed, together viith costs totalling £9 6s. Mr. D. M. Findlay appeared for plaintiff, and Mr. A. W. Blair for defendant.
