BANKRUPT'S CONVICTION AFFIRMED.
JUDGMENT IN THE DARBY CAS& Judgment in the case of Walter Erani cifi Darby, who appealed agadnet his conviction ab Auckland for failing to keep proper books and for contracting debts without having reasonable expectation of being able to pay them, was given, by, the Court of Appeal this morning. The Chief Justice said the court was of opinion that it was not necessary to call upon Mr. Salmond, counsel for the Crown. The errors in bookkeeping were more vital than one or two mistakes. The failure to keep proper booka seemed not to be a wilful act, but merely negligence, but Darby must ha-ve knowi* fchati he was in a, perilous position. Thed-e was evidence to go to the jury, and tha conviction must be affirmed. The other; judges concurred. Mr. F. Earl, with him Mr. E. W. t Burton, appeared for appellant.
