CUSTODY OF A CHILD.

Mr. Justice Edwards heard in the Supreme Court yesterday the case of King v. King, an appeal from the magistrate (Mr. W. G. Riddell) against an order made by him on 12th July last by which he directed Alexander King to pay lQs per week for the support of his child. Mr. T. Ncave appeared for appellant, and Mr. Petherick for the respondent, Fanny King. Tho facts were that appellant and respondent, hpsband and wife, lived together until September, 1908, when they quarrelled, and the wife left her husband, taking with her tha child Shortly afterwards appellant regained possession of the child and kept him until April, 1909, when the wife again got possession of the child. On 6th July she laid a complaint against her husband for .maintenance of the child, -and the magistrate made an order for tho payment of 10s weekly. It was against this order that appellant appealed, upon the ground that inasmuch as the wife had taken tho child without his consent he had not been guilty of any failure or neglect to supply maintenance. His Honour ordered tho case to be referred back to the magistrate for a statement of his finding of fact.
